Terms of Service

1. Service Description
HotTrace is a commercial real estate owner-intelligence platform that aggregates and presents publicly available land-record, entity-registry, and contact-verification data. The platform includes three tools: (a) a parcel map with Opportunity Zone overlays, (b) a Nevada Secretary of State entity and officer lookup, and (c) a CoStar contact cross-reference and phone-liveness verification tool.
HotTrace is designed for licensed commercial real estate professionals conducting lawful outreach. It is not a consumer reporting agency, and the data it provides may not be used for purposes governed by the Fair Credit Reporting Act (FCRA), including tenant screening, employment background checks, or personal credit decisions.
2. Data Sources and Accuracy Disclaimer
Data presented on HotTrace is sourced from public records, including county appraisal district rolls, state secretary of state filings, and federal opportunity zone designations. These sources are provided “as is” and may contain errors, omissions, or stale information.
No warranty of accuracy. HotTrace does not warrant that any data — including parcel boundaries, ownership names, mailing addresses, officer listings, entity status, or contact information — is accurate, complete, current, or suitable for any particular purpose. Public records may lag actual ownership changes by weeks or months.
Verify before relying. Users must independently verify any data before using it as the basis for a business decision, legal action, or outreach campaign. HotTrace accepts no liability for decisions made in reliance on the data it presents.
3. AI-Assisted Processing Disclaimer
Certain features of HotTrace — including entity name normalization, officer extraction, legal-form classification, and contact data structuring — use AI-assisted processing powered by large language models. AI-assisted outputs may contain errors, hallucinations, or misclassifications even when input data is accurate.
AI outputs are not guaranteed. HotTrace does not represent that AI-assisted results are correct, complete, or legally reliable. Users must treat AI-generated content as a starting point for further human review, not as a definitive source of truth.
4. TCPA and DNC Compliance
Customer is solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry, and all applicable state telemarketing and privacy laws. HotTrace provides data only and does not warrant fitness for any specific outreach campaign.
HotTrace surfaces Do Not Call (DNC) registry status alongside phone numbers as a convenience. This display does not constitute legal advice and does not relieve users of their independent obligation to conduct DNC scrubs before any outreach. DNC status can change; users are responsible for obtaining current DNC data from authoritative sources before initiating any call campaign.
HotTrace implements quiet-hours enforcement (calls restricted outside 8am–9pm in the recipient’s local time zone) as a reasonable safeguard, but users remain solely responsible for verifying applicable time-zone restrictions, consent requirements, and any additional state-law obligations.
Data retention: phone numbers and contact data retrieved via skip-trace pulls are automatically deleted after 90 days unless the user has recorded a disposition other than “uncontacted.” Users must not export, store externally, or re-use contact data in violation of applicable law.
5. Acceptable Use
Users agree not to:
- Use data for FCRA-regulated purposes (tenant screening, employment, credit)
- Scrape, bulk-download, or systematically export data beyond what the platform allows
- Resell, redistribute, or sublicense any data obtained through HotTrace
- Use the platform for harassment, stalking, or any purpose that violates the privacy rights of individuals
- Exceed the rate limits on phone-number exports (25 numbers per minute per user)
6. Limitation of Liability
To the maximum extent permitted by applicable law, HotTrace and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the platform or the data it provides, even if advised of the possibility of such damages.
HotTrace’s total liability to any user for any claim arising out of or relating to these Terms or the use of the platform shall not exceed the amount paid by that user to HotTrace in the three months preceding the claim.
The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
7. Changes to These Terms
HotTrace reserves the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
